Ex-UKIP candidate cleared of laptop row assault

A FORMER local elections candidate for the UK Independence Party has been cleared of assault after a row over the sale of a laptop computer left another man unconscious.

Paul Clarke, 28, of Portland Drive, Merstham, had been accused of?assault occasioning actual bodily harm, in?relation to a confrontation with Elvis Hames at his home in Kings Cross Lane, South Nutfield, on April 11 this year.

The dispute started the day after Mr Clarke bought a £600 laptop from Mr Hames's partner, Vicky Adams,?which he came to suspect was stolen, Guildford Crown Court heard.

“He [Mr Clarke] visited Mr Hames at the home he shares with his partner, the home he shares with his children,” said prosecutor Elizabeth Dean during a three-day trial last week.

“He drove to the address and once he arrived he assaulted the complainant," she claimed.

“Mr Clarke got out of the car and swung a punch at Mr Hames.”

Ms Dean?told the court?that Mr Clarke was?restrained on the ground and the police were called.

She went on: "Mr Clarke repeatedly asked to be released saying he would get back in his car and leave if he was.

“When Mr Hames released him, he was repeatedly punched and kicked until he was unconscious.”

Mr Hames denied he still had the?£600 when Mr Clarke visited his home, and also?rejected defence barrister Lionel Blackman’s assertion that he initially offered £500 back, later reducing that to £450 and?then withdrawing the offer altogether.

Mr Blackman claimed?that his client was acting in self-defence and that Mr Hames lunged at?Mr Clarke in response to?a jibe about his behaviour in front of his children.

“You [Mr Hames] leaned through the passenger window trying to grab him and punch him,” Mr Blackman said.

“To avoid you, Mr Clarke fell out of the car, out of the driver's door.”

Jurors?returned a verdict of not guilty on Monday on one count of assault occasioning actual bodily harm.

Former soldier Mr Clarke received a 12-month suspended sentence last December after walking into a police station with a sawn-off shotgun he said he had?found dumped in his garden.

He was convicted of possession of a prohibited weapon.

Mr Clarke was supported in that case by UKIP leader Nigel Farage.

He went on to stand for the party in the Reigate & Banstead Borough Council local elections in May this year,?finishing fourth with 326 votes in Merstham ward.

VIDEO - Man jailed for Donal MacIntyre assault

THE man who attacked undercover TV reporter Donal MacIntyre in a bar in East Molesey has been jailed for two-and-a-half years.

James Wild, 47, of Bridge Wharf, Chertsey, appeared at Guildford Crown Court for sentencing on Friday having been previously convicted of assault?occasioning actual bodily harm on Mr MacIntyre and his wife Ameera.

He?was given a two-year sentence for the assault on Mr MacIntyre and six months more?for assaulting his wife.

The?incident came as a result of a 1999 documentary made by the reporter on the Chelsea Headhunters firm, which led to a notorious football hooligan being jailed.

Sentencing Wild, Recorder Laurence West QC?said: "What happened in my view, having heard all of the evidence, is that following the original incident you were one of the figures involved in the further attack on Mr MacIntyre.

"You were involved in the?attack in the foyer of the club where Mrs MacIntyre put it that people who attacked her husband were on him like a pack of wolves.

"Wolves is giving them too much credit because wolves have courage."

Wild's?trial, which lasted?a week, heard the MacIntyres were at the Cloud 9 bar on June 17 last year when they were attacked.

Mrs MacIntyre?had been?due to go for a brain scan the next day.

An?altercation was sparked after they were approached by a man dressed head to toe in black, who began shouting at Mr MacIntyre.

The couple ran to the toilets but were surrounded by a gang as they attempted to leave. Mr MacIntyre was knocked over and hit by James Wild as he tried to get up.

He suffered?a black eye as a result of the attack, while his wife was left with bruises.

Gregory Fishwick, defending, said he was forced to go sift through a "binload" of references because of his client's good reputation.

"James Wild is a loving, giving, caring and hardworking man who does what he can for others, particularly with regards to his charity work," he said.

"His wife, his child, his fledging business would be affected if he is incarcerated."

The 25 days Wild spent on remand will count towards his sentence.

Speaking after the sentencing, Mr MacIntyre said?he was?very pleased that?"justice had been done."

But he added: "It is with great regret that only one of the 10 people who were involved in the assault were in the dock.

"I would invite Surrey Police and the CPS (Crown Prosecution Service) to review this case and to review the support they give to witnesses.

"I am still grateful for the support?of my wife who had to go through what she and my family members shouldn't ever have to go through."

A man who returned to England, earlier this year, to be closer to family recovers health problems suffered a setback after being attacked at Guildford High Street.

Simon Vicary, 55, who suffers from depression and anxiety, said he had been left in much pain since the incident last Thursday (October 14).

He said: "I was walking to Sainsbury's in the afternoon, when the attack went."

"I was contacted by a man, and find it me in the abdominal region."

"I was sick with depression and I could not sleep because it occurred."

Mr. Vicary is returned to the United Kingdom in February, to live in Guildford, after 35 years in America.

He said: "I lived in Los Angeles and Atlanta and nothing like this has never happened me before."

"This is what looks like Guildford? this is the great day."

"It must have been all kinds of people who saw him."

Surrey police spokesman said: "the incident occurred at 5: 35 pm autour when the victim walked up to the high street to Sainsbury's to do some shopping."

"The suspect shouted him as he walked past and tried to push him."

"The victim attempted to market, but it has been addressed by the suspect, who is on the left, causing pain to its shores."

"The victim had alerted a security incident supermarket guard and police were called".

The spokesman added that one aged 33 of Guildford was arrested on suspicion of assault.
