Teenage driver admits causing Send death crash

A TEENAGE driver has been warned he could face jail after he admitted causing the death of a popular and talented Woking youth footballer in a fatal car crash last year.

Luca Bertolone, 19, of Woodham Waye, Woking, broke down in tears as he pleaded guilty to the charge of causing death by careless driving while unfit through drink or drugs at Guildford Crown Court on Friday.

His friend, Thomas Difelice, 17, from Woodham, was a passenger in?the red Mini being driven by Bertolone, which came off the road and hit a wall in Broadmead Road, Send, on December 15?last year.

Hundreds of mourners attended the funeral of Thomas,?and Arsenal manager Arsene Wenger sent a message of condolence to?his family.

Thomas, who was a former pupil of St John the Baptist School in Woking, also played for a number of local football teams, including the youth academy?at Woking FC.

Simon Stirling, mitigating for Bertolone, said: “This is a young man facing a serious offence, but your honour will note that he is a man of just 19 years of age and previous good character.”

Delaying sentencing for reports to be compiled, Judge Suzan Mathews apologised to the?Difelice family for the time the case had taken to?get to court.

She said: “It is a matter of concern to me that it has taken this long to reach this stage.

“I’m disappointed this is causing further delay but I do accept for this age and background that the court needs the full information.”

Judge Matthews warned Bertolone all options would be considered.

She said: “Given the totality of what has gone on, you should be realistic that you could lose your liberty.”

Bertolone was granted conditional bail, but was ordered to surrender his driving licence.

He will return to court on February 3 to be sentenced.

River death man 'deeply affected' by war struggles

THE IRANIAN man whose body was found in a freezing?Ewell river?had been?"deeply affected" by atrocities he witnessed following the Iraqi invasion of his homeland.

Jason Khalili, 52, was found dead in the Hogsmill River near Green Lanes on December 1.

Father-of-five Mr Khalili, who grew up in Tehran, the Iranian capital, served as an army medic during the conflict?between Sunni and Shiite Muslims?before moving to the UK in 1995.

During the war – which ran from 1980 to 1988 and claimed millions of lives – he was based in the south west of the country where some of the most intense fighting was seen.

A?woman who knew him from the early 1980s,?but did not?want to be named,?said?Mr Khalili?underwent a dramatic personality change following the conflict.

"After the war he was always angry, angry at Iraq, angry at everyone," she said.

"Because he was under so much stress during that time he had emotional problems that lasted for the rest of his life.

"We saw so many awful, horrible things during the war – hospitals being bombed, fathers carrying the bodies of their children through the streets.

"That deeply affected him in everything he did."

Family members went to?Mr?Khalili's?home?in Epsom after his body was found, and they discovered a handwritten list of people to notify of his death and a will leaving all his possessions to the eight-year-old daughter he fathered with partner Emily Smith.

His keys, wallet, mobile phone and shoes were also left inside the house.

At the time of his death, Mr Khalili was subject to a three-month suspended prison sentence, imposed by Redhill Magistrates' Court on September?23 this year?for common assault.

He had also been due back in court?for allegedly breaching the terms of?the community order he was handed.

Mr Khalili was previously?jailed for 26 weeks in 2009 for slitting his own dog’s throat, although it was?later revealed he had acted to save his son Massoud who was being attacked by the animal.

"When he wanted to be a nice person he was the best, there were several women who loved him very deeply,"?the woman?added.

"He would do anything for his friends and family and will be sorely missed by them."

No charges after careless driving death arrest

A RUBBISH truck driver who was arrested over the death of a Polish man in Woking will not be facing any charges, police have said.

The 40-year-old from Guildford was detained on suspicion of causing death by careless driving on the morning of Easter Monday this year, shortly after he had alerted emergency services to a man with head injuries who was lying in a service area in Chertsey Road.

Marcin Miszcuzk, 33, was taken to St Peter's Hospital in Chertsey where he was pronounced dead.

Police had been called to the scene at around?5.30am on April 5.?The driver was arrested a couple of hours later and then freed on bail while inquiries continued.

But in?a statement released by police this week, Detective Sergeant Gary Wright, from the?Collision Investigation Unit, said: "We have carried out a thorough investigation into this incident with our colleagues from Woking CID.?

“We do not have the evidence to establish that the driver committed the offence of causing death by careless driving.

“There are no other suspects and no further lines of inquiry and the matter of the victim’s death will now be heard at?an inquest, a date for which will be set in due course.”

Police said the?circumstances of Mr Miszczuk’s death?were also?still being investigated by the Health and Safety Executive.

The arrested man had been?behind the wheel of?a 32-tonne refuse collection vehicle,?owned by Guildford-based waste management company Chambers Ltd, where the driver was also an employee.

Mr Misczczuk had been living with his brother and sister-in-law at a flat?in Woodlands Court, near Woking town centre.

Following his death,?neighbour and friend Nilesh Mahavir said he was "a really nice guy".

"You couldn’t have asked for a nicer neighbour," he added.

“He was always smiling. He was always saying ‘Hi, how are you?’.”

A MAN who fell to his death from a bridge over?the M3 close to Chertsey on Wednesday was a patient at a nearby mental health unit, it has been confirmed.

A spokesman for Surrey and Borders Partnership NHS Foundation Trust, which runs the Abraham Cowley unit at St Peter's Hospital, confirmed the victim?had been under their care prior?to Wednesday.

He said: "Surrey and Borders Partnership NHS Foundation Trust offers its sincere condolences to the family.

"The trust is assisting Surrey Police with their inquiries and will be conducting an internal review of the care and support provided."

The M3 was closed for several hours after?the man?fell from Bridge Road, Lyne,?onto the southbound?carriageway of the motorway at 5.15am on Wednesday.

A police?spokesman?said: "Surrey Police is appealing for any witnesses and in particular is asking for any motorists using the motorway in the vicinity of the incident location, between 5am and 5.30am, to contact officers urgently on 0845 125 2222, quoting reference RM/10/7554."

A3 death crash driver fails to have sentence cut

A DRINK-DRIVER who caused two motorists' deaths after?speeding at up to 100mph?on the A3 between Cobham and Esher has failed to convince judges to cut his 11-year jail sentence.

Lawyers for Deane Girdler unsuccessfully challenged his?prison term at the Appeal Court in London on Friday last week (November 5).

It was imposed for two counts of causing death by dangerous driving after the pile-up on January 19, 2008, which killed Weybridge cab driver, Preston Trueick, 61, and Catherine Cunningham, 67, from Liphook.

Girdler, of Fullmer Way, Woodham, who smelt of alcohol in the aftermath of the crash, was convicted at Kingston Crown Court in March this year.?He was also banned from the road for 10 years.

Lord Justice Gross, sitting with Mr Justice Ramsey and Mr Justice Hedley, said the 45-year-old hit speeds of around 100mph as he approached the scene of the tragedy at Copsem Lane.

Other motorists had been alarmed by his erratic driving, the court heard, tipping off police after seeing him veer across lanes, tailgate cars and drive with palpably slowed reactions.

The double tragedy came when Girdler, who was living in Cobham at the time, hit the back of Mr Trueick's cab, skittling it across the?carriageway so that it straddled the central reservation.

Mr Trueick was struggling to flee from his taxi?when?Mrs Cunningham's oncoming car smashed into it.

Lord Justice Gross said Girdler “smelt strongly of drink” when he emerged from his own car, but repeatedly failed to provide a breath specimen for analysis.

Letters from both victims' families spoke of the "devastating" effect of their deaths, said the judge.

Both letters also referred to the total lack of remorse shown by Girdler.

Given the horrific facts of the case, an 11-year jail term "cannot be described as manifestly excessive", the appeal judge concluded.

Kitty teen stabbed to death on seawall

- One assailant nabbed under bed, other in cupboard

The Diwali Motorcade celebrations ended in tragedy for one family last night after a Kitty teenager was stabbed to death on the seawall.
Dead is Dwayne Durant, 18, of Gordon Street, Kitty.
Durant’s attackers, believed to be two brothers and said to be in their teens, were captured by police hiding in their Garnett Street home, about two hours after the killing. One was hiding under a bed, while another was in a cupboard, police sources said last night.
According to Kijanna Wharton, a friend of Durant who was with him at the time of the incident, around 21:30hrs, Durant, himself and another friend, were walking just east of Sheriff Street on the seawall.
They were approached by three persons, including the two who were later captured.
According to Wharton, the assailants were known to them since they were involved in an altercation two months ago.
“We thought that was finished. This man come up to us and ask we if we looking for them and if is trouble we want,” Wharton said.
One of the teenagers in Durant’s group apparently threw a punch at the others and one of them fell over the seawall in the ensuing scuffle. Durant was also pushed over the seawall onto the rocks and it was during this time that the person who was there pulled out what was described as long knife and stabbed him in his neck.
“The knife went deep in he neck. Meh other friend also get juk up. He in de hospital.”
The three attackers immediately ran away.
Wharton said they attempted to secure a vehicle to take Durant to the hospital but no one stopped.
As a last resort, they reportedly placed him on the middle of the northern carriageway of the East Coast Public Road where a Rav 4 eventually pulled up and took him to the Georgetown Hospital. However, it was too late for the teenager who would have celebrated his 19th birthday on December 4.
Police later went to a Garnett Street house in Newtown, where they found the teenaged suspects hiding. Their mother reportedly also handed over a knife that was suspected to have been used in the murder.
The two suspects were taken to the Kitty Police Station.

A MAN has admitted the manslaughter of a homeless former?soldier who died after being pushed?into the River Wey in Guildford last year.

Kenneth Lloyd denied murder but pleaded guilty to?the lesser charge?during a hearing at Guildford Crown Court on Wednesday.

He pushed 57-year-old Dominic Smith into the river close to the Odeon cinema on?November 24, 2009. The victim died in hospital the following day.

Defence barrister Marcus Tregilgas-Davey said on Wednesday that psychiatrists had agreed?Lloyd was now to fit to plead having undergone several mental health assessments

“We have had the opportunity to have conference with him and what the doctor says in the last paragraph of his report seems to reflect the position,” he added.

Prosecutor Mark Milliken-Smith said they could not be confident of proving that Lloyd's actions had amounted to murder.

“The Crown takes the view that in the background of drink being taken, a jury could not be persuaded of an intention to kill,” he added.

Judge Christopher Critchlow remanded Lloyd, of Ashridge Way, Sunbury Cross, in custody to re-appear before the court for sentencing on January 7.

“It’s taken a number of months since this matter first came to court and there have been a number of reports from psycharists and psychologists,” the judge said.

"This should be put back for further reports before sentence."

Mr Kelly was well known around homeless centres in Guildford and the surrounding area.

He was spotted floating in the river and was dragged out by the emergency services before being taken to the Royal Surrey County Hospital, where he was later pronounced dead.

Truck driver slapped with 12 counts of causing death

Thirty-eight year-old Chetram Moonsammy, of Johanna, Black Bush Polder, Berbice, appeared at the Berbice Magistrate court yesterday before Magistrate Adela Nagamootoo to answer to 13 charges.
Moonsammy was charged with 12 counts of causing death by dangerous driving and one count of failing to render assistance.
It alleged that on Friday, October 29, last, he drove motor lorry GLL 8863 in a manner dangerous to the public and claimed the lives of 12 persons while injuring five others.

That information was sworn to by Sergeant Forbes Brown.
Police prosecutor Roberto Figueira told the Magistrate that the defendant should be remanded to prison citing the seriousness of the offence. He said that the defendant allegedly caused the death of 12 persons and if granted bail would flee the jurisdiction. He said that the offence was committed on the Number 19 Corentyne Public Road, Berbice, and that the said lorry driver did not offer any assistance. He fled the scene but was arrested at the Whim Police Station.
Attorney at law Mursaline Bacchus appeared on behalf of the defendant, and made an application for bail. He informed the Magistrate that the offence is a bailable one and that his client did not act recklessly and if he did, he would have been charged with manslaughter.
He stated that his client on the day of the incident did not flee the scene, but instead reported at the Whim Police Station and was brought back to the scene.
Bacchus told the court that the fact 12 persons died does not mean that his client is guilty and refusal of bail should not be used as a punishment.
Moonsammy’s attorney also made reference to a report in the media which stated that the driver of the bus that was involved in the accident ‘was at fault’ and that the police did not refute such claims.
The Magistrate however objected to him using print media information.

Bacchus went on to explain that the prosecutor did not submit any growing evidence and he did not see why his client should be denied bail.
The lawyer told the magistrate that his client lives with his wife and is tasked with providing a livelihood for three minors. He owns 150 acres of rice fields which is in its period of harvesting, and if incarcerated, he will lose all his crops. In addition to his lengthy bail application, the passport due date of the accused was also submitted as proof for bail to be granted.
It appeared that Bacchus’s submission fell on deaf ears as Moonsammy was remanded and will return to court on January 3rd.
Bacchus then informed Magistrate Nagamootoo that he would be moving to the High Court for bail.
On Friday, last, Oudit Narine Baboolall, who was the driver of the of the minibus; Orlando De Mattos, Talita Mendonca and her two-month-old son Josiah Khan; Janet Baker, 46-year-old Salima Dilmohammed, Salmaa Razaac, Cindy Jaggernauth, 35, Patricia Asgarally, 38 year-old Chetram Ramphal, Nazradin Mohinudin and Marquest Ault were killed in an accident on the No.19 Corentyne Public Road.
The route 63 minibus was heading east along the thoroughfare when it collided with a truck driven by Moonsammy.
It was reported that it was raining at the time of the accident.
The five survivors are Tamika Fraser, of Kildonan; Sham Jaggernauth, of Nigg; Nicola Ross and Anwhatie Singh.

GPHC launches investigation into the death of nurses

A preliminary report on the death of nurse Charlene Amsterdam should be available on Thursday, according to the release of the Georgetown Hospital yesterday afternoon.

Man admits to death threats from Barclays hostage siege

A CONVICTED thief admitted terrified holding staff and clients as hostages in a bank in Ashford, armed with toy gun black painted child and an improvised bomb to false.

Unemployment Matthew Nutley, 36, avenue in the city, Brookside pleaded guilty Friday to charges of armed robbery, false, possession of a firearm with intent to commit an armed robbery, two counts of threats to kill, blackmail, possession of an offensive weapon and make a hoax bomb making imitation weapon imprisonment.
